According to this article it was indeed brandishing under Florida law.

Maybe they treat us different as we are in street cloths and often times riding to the fish market or the beach. But I've never had a problem down there. It's really sad that so many Americans find it so easy to solve all thier problems with a gun. It's like they don't realize the repercussions of actually killing another human being. If I was that cyclist I would be contacting the police. |

I work in GA often where (at least in some counties) open-carry is permitted. Gives a whole nuther concept to what is 'brandishing', especially when you're sitting in a restaurant trying to have a peaceful meal....
