Was hit by Super 73 head on a couple years ago. He crossed into my side of path to pass a pedestrian. Totaled my SV, broke my finger. I was concussed.

I asked guy for info, he refused saying I seemed angry and he didn't know what I'd do with info. I took picture of him and left to get to urgent care to get my finger taken care of before they closed and I would wind up going to ER for $10,000.

Went back and found guy three weeks later on path same time, same day. He was obviously military student at the Naval Postgraduate School. He continued to deny responsibility. I called police and he steamrolled new police officer and left without giving info. However, I had gotten enough information from him to find his name and address. He is a Major in the USMC in Military Police field. Knew exactly how to manipulate situation.

Filed report with my insurance and got the bike paid for under homowners minus deducible. Tried for medical, but insurance fought cats and dogs until I go a lawyer. Then they called witness and badgered her into admitting that it had been a year since accident and maybe she couldn't remember. So, I got nothing there.

Gotta remind myself to always call police. It's hard when you're concussed. Maybe as humans, if we see someone who's been injured in any way to insist on calling for police and ambulance. I would have been way better had someone encouraged me in this way. Would have cost way more up front, but could have gotten all medical expenses covered, and probably bike without deductible. But, in general, people do not want to be involved.

To OP, IMO you are going to have a hard time. If there is enough damage you could file police report and claim on your homeowners, but you have deductible to deal with.

TBH I am amazed we don't have way more posts about riders getting hit by other riders and/or riders being mad about bikes being destroyed in group rides.

I saw plenty of bikes destroyed in racing, saw some parking lot arguments and fights, etc..

And back then people seemed to be way less likely to splash out on a TdF level bike to go race Cat 6, to say nothing of actual real racing.

I still have always felt like a group ride with anything but a very select group of people I knew to be the most dangerous riding behavior.

There are a lot of these kinds of accidents on the local MUT to the point it's got quite a reputation. As bad as people are with their driving behavior they seemed to get worse on the MUT.

Sonoma County has several nice MUTs that I use frequently.. and I used to use the 56 trail in North San Diego often as way to get over to the beach.. I can probably count on less than one hand the number of times I'd had an issue that cause me to significantly vary my course or speed.. now, I also was never trying to set a speed record on these trails either.. and if I ever come up to other users, I always cover my brakes and ensure they know I'm there..

Bottom line is I, as a cyclist, assume that folks on the MUT are going to act erratically as they are walking their dogs, talking on a phone, looking at the flowers, etc.. I assume the same when walking on a sidewalk (that people will NOT walk in a straight line)..

I've never had a significant issue on the MUT but I ride pretty darn cautiously just like you and it's fairly rare I'm on it anyway. The traffic on it slows me down significantly compared to staying on the road, probably about -5mph average speed, so I have to have a really good reason to use it where I specifically just want to go up to the next town center for some reason, because it is the shortest path.

But they show up in the police blotter and such.. it's pretty dangerous, eBikes/eMotos are not making it better, and I'm amazed to meet parents who let their kids ride around town but forbid them from going on the MUT.

This scenario is different than the OP's.

Reading Bob Mionske's book, Bicycling and the Law (he's a lawyer and former national champion), he says be engaging in a group ride or race you assume a certain amount of risk, so calling another party responsible for damage to your bike/self can be a real reach.

In the OP's situation, I don't believe there was assumed risk.

While it may be worthwhile calling the police for a bike on bike crash, Im pretty sure here in Chula Vista (CA) there would be zero interest from them in coming to take a report.....
