35-40mm tire clearance is low for a 400 axle to crown fork. It just means you have a bunch of wasted space up there, or unusually narrow legs. There's no practical advantage to having a fork with less tire clearance.
Just get one of the many forks that meet those specs with more tire clearance and call it a day.
