I go before the judge tomorrow. My charge; riding two abreast. I got a ticket last fall for riding two abreast. I was riding along the edge of the road, to the right of the white line, another fellow was riding on the shoulder next to me. I was pulled from the group and written a ticket. The other guy was not in the travel lane or in a bike lane, he was riding on the shoulder. So I am fighting the ticket on the grounds that I was exactly where Florida law says I was supposed to be. As far to the right in the travel lane as is safe and practical. I have a real live lawyer representing me (for free), an expert witness (the countys former bike/ped coordinator) 8x10 glossys with a description written on the back of them and god on my side.

If I stop posting for a while I'm in the big house :(

Make sure the judge is not blind with a seeing eye dog for those 27 8x10 color glossy photographs with a paragraph on the back of each one explaining what each one was. It would be yet another case of American blind justice.

Bill, what we have here is a failure to communicate. I think this is clearly a case of police persecution and your lawyer should definitely be going after the officer, his department, and his city as they have clearly violated your legal right to freedom of travel.

3 hours on the mtb. Beautiful Sky, 60's temp and good friends. Got muddy, got wet, got muddy again and washed it all off again crossing the Econ river. Long sleeve jersey and regular cheap shorts.

If I was the judge I would admonish the cop for not thinking about the purpose of the law. I bet the code is silent on riding two abreast on the shoulder, but the clear intent of the rule is to avoid impeding traffic. You were not doing that by definition, so the cop pursuing you is a "gotcha" move probably fed by an antipathy towards cyclists. I would also admonish his supervisor and suggest that literal interpretations of the law is for rookies. If I could, I'd sentence the cop to 20 hours (of non-paid time) sweeping the debris out of the shoulder so he'd remember forever what cyclists are asked to do.

It's not a joke. There is lot's of history concerning cycling on that road. Bill knows a lot more about it all but from my perspective part of it is about rich people (not that there is anything wrong with that) dont want cyclist, cycling lanes, or anything cycling related on their stretch of road. Another part is some cyclists are morons and and have created some history with the law enforcement agencies along there and now good folks like Bill get harrassed. A few bad apples you know.

BTW, Bill, maybe I should ride the Legend while you are in the joint. I'll remind Mike to feed the cats.

My dad lives down there but doesn't ride much but respects cyclists and is concerned for their safety. The issue as I understand it from residents, local cyclists and my observations is that the problem is largely due to large, aggressive wc groups.

I was down there visiting this past January and rode up and down A1A for the first time in two decades. I have to admit that it was odd to repeatedly hear from cyclists that cops are tough on cyclists and was shown a few places where they hide in bushes next to stop signs and traffic lights. If I'm not mistaken, those hiding spots were close to Bill's town.

Coming from combative Washington, D.C., I was pleasantly surprised how friendly motorists were, including patrol officers. One cute blonde stepped out of her patrol car and offered assistance as I was fixing the rental bike.

I told her some fat cat needed help further down the road :D

The law says the shoulder is not part of the roadway, the cop said that even though one of us was on the shoulder a car could not safely pass us. we argued that the ticket was not for blocking traffic but for riding two abreast and that since i was riding where the law tells me i am supposed to ride i could not be blocking traffic. we shall see.

She seemed genuinely impartial, however she did rule against the defendant in every preceeding case. I would have felt better if at least one of them had won. did i mention she was hot?

The fact you brought a lawyer to fight a 38.50 fine probably raised the red flags...

If you're on solid ground, your lawyer won't have much to tilt at...but even small positive rulings are good rulings.
