So I got a 2.1” tire in there but is it too close to the stays?

Not if you don't care about the paint there...:)
Can you put in a 5mm allen wrench in the gap? If not, I would say that is too close.
By the way, is that an Open UP?

It is 5.6mm on either side measured using calipers

I would ride that in dry conditions, but not in wet / mud.

I've ridden with that amount of clearance before, but as OP stated your paint may suffer.

My steel Rock Lobster mountain bike was specifically built around 2.1" tires.
I've got 8.1mm of a gap from the knobs to the inside of the chainstay.
Your 5.6mm will work as long as the wheels don't go out of true.
I'd monitor it and at the first sign it's taking off paint, I'd permanently stop using those tires and install something narrower.

As others have said, ride in dry, caution when wet. That said, apply some protective film (Helicopter blade tape) on the inside of the stays to be on the safe side!

Road clearance that really matters is the top of tire to bottom of brake caliper. What's the right amount depends in your risk aversion and road surface conditions (tar gravel dirt smooth wet/dry etc)
Sidewalk to stay is a paint rub issue not a flip forward head first issue
