Probably. They will loosen up with use. Maybe not as fast as DA but they will in time. Once that happens, they will work fine.

Yep. I have a pair with maybe 5000km on them and they fall to the lowest position with practically no resistance.

You can take it to a bike shop and they can loosen it by merely adjusting it, or maybe thinning the grease a little. But they do tend to loosen with use. They should not spin freely as this indicates the need for grease. There should be a little resistance, but they should drop into the proper engagement position.

I bought a pair about a year ago. The left pedal rotated into the proper position just due to gravity, but the right pedal would not. The bearings were way too tight. They're easy to adjust, however, and an adjustment was all I needed. I would think your LBS could do it rather quickly and inexpensively.
