My experience with the Colorado Highway Patrol when I got hit from behind was much different(ok treatment, concerned, phone call after getting home, etc) but this is amazing.

Ahhhh, didn't read that one as I doubt any cop 'hates' a cyclist. Hate is a big word and bandied about too frequently, IMHO. Cops may be impatient, overly aggressive, snippy, but hate isn't the word I would use.

I don't even 'hate' sp(r)am. Don't like it but don't hate it.

MODS- delete or merge, whatever is appropriate.

I read the thread and the article yesterday.

I can't see how the officer could have charged Matt with "something amounting to failing to move over when being overtaken". It's the responsibility of the overtaking driver to perform a safe pass. The front vehicle does not maintain constant awareness of traffic behind when they're traveling forward, and a bicycle in Colorado is not required to be equipped with a rear view mirror.

Even if Matt relied upon hearing to detect the approaching car, the hearing distance would leave to small a reaction time to result in a useful move to the right.

I expect the judge will toss this out if Matt chooses to fight the charge.

Not quite. Colorado, like most states, generally follows the uniform traffic codes, which requires a vehicle being overtaken to give the right of way to the passing vehicle by staying to right side of the road. From Colorado statuate 42-4-1003 "Overtaking a vehicle on the left":

"c) Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on audible signal and shall not increase the speed of the driver's vehicle until completely passed by the overtaking vehicle."

Not stated in the article is whether or not the car made an audible signal before attempting to pass.
