It's an interesting patent and not the first time stuff like this has been discussed. I highly doubt any certifying agency would permit it though because of the lack of crashworthiness of the seats.

In addition to the Boeing 777 being very robust, it's generally thought that many more passengers would have been much more severely injured or killed in the crash in San Francisco of the Asiana flight had the seats not been the stronger seats that are now required. They are far stronger nowadays than they were 30 or 40 years ago.

I'll be amazed of these 'standing' seats ever see the light of day on a real flight.
